§01

Accepting these terms

TL;DR

Using the app means you agree to these terms. If you don't, please don't use it.

These Terms of Service ("Terms") govern your access to and use of the AisleWatch mobile application, websites at aislewatch.app, and related services (together, the "Service"), provided by AisleWatch, Inc. ("AisleWatch," "we," "us"). By creating an account or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree to these Terms, do not use the Service.

§02

Your account

TL;DR

You must be 13+, give us a real email, and keep your password to yourself. You can delete the account whenever you want.

To use most features you need an account. By creating one, you confirm that:

  • 01 You are at least 13 years of age (16 in the EEA where applicable).
  • 02 The email and any other information you provide is accurate and yours.
  • 03 You will not share your password or transfer the account to anyone else.
  • 04 You are responsible for activity under the account, including any household members you invite.

You may close the account at any time via Settings → Delete account or at aislewatch.app/account/delete. We may suspend or close accounts that violate these Terms, abuse the Service, or pose a security risk, with reasonable notice unless the abuse is severe.

§03

Acceptable use

TL;DR

Use AisleWatch for tracking your own grocery shopping. Don't scrape it, abuse it, or use it as a wholesale intelligence pipeline.

You agree not to:

  • 01 Reverse-engineer, decompile, or attempt to extract source code from the Service.
  • 02 Use automated scripts, scrapers, or bots to access the Service without our written permission.
  • 03 Upload receipts you do not have the right to scan, including receipts containing other people's personal information without their consent.
  • 04 Submit unlawful, defamatory, or malicious content, including malware-laden images.
  • 05 Use the Service to build a competing product, or to commercialize price intelligence at a scale beyond personal household use.
  • 06 Interfere with or disrupt the Service's integrity, security, or performance.

We reserve the right to investigate and take appropriate action against any conduct we determine in our sole discretion to violate these Terms, including content removal, account suspension, and reporting to law enforcement where required by law.

§04

Subscriptions & billing

TL;DR

AisleWatch Plus auto-renews via Apple. Cancel anytime in your iPhone's Settings. Refunds go through Apple, not us.

The core Service is free. AisleWatch Plus is an optional auto-renewing subscription billed by Apple through your App Store account.

  • 01 Your subscription renews automatically at the end of each billing period unless canceled at least 24 hours before the renewal date.
  • 02 Your iTunes account will be charged for renewal within 24 hours prior to the end of the current period.
  • 03 You can manage and cancel subscriptions in your iPhone's Settings → [your name] → Subscriptions, or at appstore.com.
  • 04 Prices are shown in your local currency in the App Store at time of purchase. Prices may change with at least 30 days' advance notice via email and in-app.
  • 05 Refund requests are handled by Apple via reportaproblem.apple.com. We do not process refunds directly because Apple is the merchant of record.

Free trial terms (when offered): one trial per Apple ID. The subscription begins at the end of the trial unless you cancel beforehand.

§05

Who owns what

TL;DR

Your receipts and your data stay yours. The AisleWatch app, code, and brand stay ours.

You retain all rights to receipts you upload and to the data derived from them ("Your Content"). You grant AisleWatch a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display Your Content solely as needed to provide the Service to you and any household members you authorize.

The Service itself — including software, design, the AisleWatch name, the wordmark, and the lime-on-paper visual identity — is owned by AisleWatch, Inc. and its licensors and is protected by copyright, trademark, and other laws. Nothing in these Terms grants you a license to use those assets outside of using the Service as intended.

Disclaimers

TL;DR

Price data is informational. We try to be accurate, but never guarantee a number. Don't make six-figure decisions based on AisleWatch alone.

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Price information shown by AisleWatch is generated from receipts you (or your household) provide and is intended for personal informational use only. We do not warrant that prices, items, or store information are complete, current, or accurate. Decisions based on this information are your own. AisleWatch is not a financial advisor, a budgeting authority, or an authoritative source on retail pricing.

§07

Limitation of liability

TL;DR

To the extent the law lets us cap our liability, we cap it at what you paid us in the last 12 months — or $50, whichever is greater.

To the maximum extent permitted by law, AisleWatch and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising from or related to your use of the Service, whether based in contract, tort, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total cumulative liability for all claims related to the Service in any 12-month period will not exceed the greater of (a) the amounts you paid AisleWatch in that period or (b) fifty US dollars ($50). Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above may not apply to you in full.

§08

Governing law & disputes

TL;DR

California law applies. Disputes go through binding arbitration in San Francisco. You can opt out of arbitration within 30 days of accepting these terms.

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by JAMS in San Francisco, California, under its Streamlined Arbitration Rules.

30-day opt-out. You may opt out of this arbitration agreement by emailing legal@aislewatch.app within 30 days of first accepting these Terms with the subject line "Arbitration Opt-Out." Opting out will not affect any other part of these Terms.

You and AisleWatch each waive the right to a jury trial and the right to participate in a class action. EU consumers retain mandatory consumer-protection rights under their local law.

§09

Changes to these terms

TL;DR

Material changes get 30 days' notice. If you don't want to accept them, delete your account before the effective date.

We may revise these Terms from time to time. The most current version will always be at aislewatch.app/terms. Material changes — anything that materially affects your rights — will be communicated by email and in-app notice at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.
